What are you signing ?

1.  Who are these documents for: This web page is for Laury  Hall, Katy Eakins, William Eakins, Diane Miller, and Gregory Miller.
 2.  Why do you need to sign these documents ? You are being asked to sign the documents because you are an Heir to the estate. In order to list the property for sale you will need to sign a listing agreement that includes making some disclosures known to a potential buyer whether you lived in the home or not.
3. What are the documents that I am being asked to sign? We are listing the property as a Probate transaction. There are required disclosures, Advisories, manufactured home disclosures and notices. 

Instructions: Please download the listing packet then sign, or initial and date wherever you see an "arrow" . Many documents will also have you print your name. 
When you are finished, please scan in PDF format and return all the documents to our email at : TrustedRA@gmail.com 
***It is important that you return in PDF format and in a single document. There are 23 pages. You can merge them all together by scanning them into an online software called: ilovepdf.com (use the merge button). It's free and  does not require any registration.
Please do not take photos of the documents or transform them through another software. They will come out distorted on our end.

This is a breakdown of costs to sell the property and the approximate amount of how much money is left.

Page 2-3 Disclosure Regarding Real Estate Agency 

This document explains the type of agency relationship you have with us as well as the duties involved.

Page 4: Possible Representation of more than one buyer or seller.

This document gives notice that we may, during the course of the transaction, may represent more than one buyer or seller.

Page 5: Wire Fraud

This is an advisory to all businesses and customers about the criminal activity that hackers are using to victimize you through electronic funds transfers.

Page 6-10: Residential Listing Agreement

Page 11-12: Seller's Advisory

This document advises you (the seller) to disclose known material facts pertaining to the property. It is intended to inform the Buyer of the Seller's obligations and duties.

Page 13: Probate Listing addendum and Advisory

The Listing agreement does not have certain probate language. This document is only an Addendum to add the language to the contract.

Page 14-15: Probate Advisory

This Advisory describes the documents that you are exempted from filling out and those that are required.

This document outlines who the Heirs are, their interest and listing contingencies.

Page 17: Manufactured Home Listing Addendum

This document is added to the listing agreement and describes the home in detail with the Decal Numbers etc, that will be sold with the real property. 

Page 18: Manufactured Home Advisory addendum and Release

This is a Hold Harmless form letting the buyer know that they do not have expertise in the area of manufactured home compliance with regards to the Health and Safety Code.

Page 19: Manufactured Home Advisory Addendum and Release

This is another form advising the buyer of occupying a used manufactured home or selling one.

Page 20: Exempt Seller Disclosure

This document outlines some of the required disclosures that the Seller has to make to a buyer.

Page 21-22: Water Conserving Plumbing Fixtures and Carbon Monoxide Detector Notice

The Water Conserving Notice is not a point of sale. You are simply disclosing its requirements. As far as the Carbon Monoxide Detectors, you are required to provide Carbon Monoxide detectors in the home, but our custom Addendum will put the responsibility onto the buyer when they submit an offer.

Page 23: Water Heater and smoke Detector

This has two parts. The water heater is a statement that you will be in compliance before the close of escrow. The Smoke Detector form is an exemption document from installing smoke detectors or even being in compliance with any laws regarding them.
